2. Acknowledgment of Risk
By signing below, I acknowledge that use of the Brooks Family backyard, including its trampoline and playground equipment, involves inherent risks. These risks include, but are not limited to:
- Sprains, strains, cuts, bruises, or abrasions
- Broken bones or concussions
- Spinal injury or paralysis
- Collisions with other participants
- Falling off or improper landing
- Equipment failure or improper use
- General risk of serious injury or death
I accept full responsibility for my child(ren)'s participation and understand these risks.
3. Assumption of Responsibility & Supervision
I understand that Tyson and Emilie Brooks are not responsible for supervising my child(ren) while they are using the trampoline or playground. My child(ren) may only play when an adult member of the Brooks family is aware they are present. Unauthorized or unsupervised use is strictly prohibited.
I agree to communicate all rules listed in this waiver to my child(ren) and ensure they understand and follow them.
4. Playground & Trampoline Rules
1. Respectful play only - no pushing, tackling, or roughhousing.
2. Multiple jumpers allowed, but must maintain safe distance.
3. No flips or somersaults on the trampoline.
4. No climbing under the trampoline while it is in use.
5. Use designated entry/exit - no jumping off the trampoline.
6. Remove shoes before jumping. No sharp objects, jewelry, or loose items allowed.
7. No food, drink, or gum on the trampoline or playground. Snacks may be consumed in designated areas only.
8. Do not misuse or overstress the trampoline net. It is designed for safety, not for launching or high-impact play.
9. Stay inside the trampoline net -- do not climb or hang on the outside.
10. No pets allowed on or in the trampoline or playground.
11. No running in the playground area.
12. One person per swing -- no standing or twisting.
13. Only go down slides -- no climbing up them.
14. Do not jump or hang from elevated platforms or roof areas.
15. No throwing toys or objects on or around the equipment.
16. Shoes must be worn at all times in the playground area.
17. Play at your own risk -- Tyson and Emilie Brooks are not responsible for injuries.
18. The Brooks family is not responsible for lost or broken toys.
19. Failure to follow these rules or engaging in unsafe behavior may result in being disallowed from future visits.
20. Rules may be updated or changed at the discretion of the Brooks family.
21. The Brooks family reserves the right to ask any child to leave the property at any time, for any reason, with or without explanation.
5. Photo/Video Notice
The Brooks family reserves the right to take and use photos or videos taken in their yard. These may include images of the trampoline and playground area. No additional release will be required.
6. Damage & Vandalism Policy
Intentional damage, destruction, or vandalism to the trampoline, playground equipment, or any surrounding structures will not be tolerated. Any individual found responsible may be permanently banned from use of the property, and their parent or guardian may be held financially responsible for repairs or replacement.
7. Release of Liability
I, the undersigned parent/guardian, hereby release and hold harmless Tyson and Emilie Brooks from any and all liability for injuries, claims, damages, or losses arising from participation in play activities on their property. This includes the use of the trampoline, playground equipment, and surrounding yard.
This release of liability also applies to Tammy Dirst, who may be present on the property from time to time. Tammy Dirst is not responsible or liable for any injuries, accidents, or incidents that may occur during use of the trampoline, playground, or backyard.
This waiver applies to all future visits unless revoked in writing.
8. Signature & Agreement
By signing below, I confirm I have read and understood the above waiver, rules, and terms of use. I agree to be bound by this agreement.
